Mediation

HOW DOES MEDIATION WORK?

Simply! The two parties bring a list of issues to be resolved. The parties work together with Ms. Courtney to create a solution to their issues. There is no winner or loser, as the end result was brought about and created by the parties and their specific needs. The parties still need independent legal counsel, but by avoiding litigation expenses, mediation can take less time and cost less than protracted divorce litigation.

WHAT TYPES OF ISSUES CAN BE RESOLVED BY MEDIATION?

All Family law matters. Divorce, custody, financial issues and property distribution.

 IS MEDIATION FOR EVERYONE?

Mediation is not for everyone. Some couples are simply unable to work together. If there has been a history of domestic violence or if there is not full financial disclosure between the couple, mediation would not be appropriate.

WHY MEDIATION?

  • It’s voluntary
  • It’s cooperative and not an adversarial process
  • Mediation can be faster than litigation
  • Mediation can be less expensive than litigation
  • Clients can be more creative as to the issues and solutions in their agreements
  • Mediated settlements are often perceived as better by the parties since they decided upon the terms
  • Mediated settlements are more likely to be followed by both parties
